Terms & Conditions of Article Submission

Please read these Terms & Conditions carefully before uploading, submitting, or transmitting your article, manuscript, text, images, or multimedia content (collectively, the "Submission") to SUCKER ("the Magazine," "we," "us," or "our") via our JotForm hosting platform.
By clicking "Submit," checking the acceptance box, or transmitting a file, you unconditionally agree to be bound by this legally binding contract. If you do not agree to these Terms, do not execute a Submission.
1. Nature of the Relationship & Compensation Waiver
1.1. You acknowledge that the Magazine is an early-stage publication operating on limited initial infrastructure.
1.2. All Submissions are volunteered completely at your own discretion.
1.3. You explicitly agree that you will receive no financial remuneration, monetary compensation, stipend, or royalty payments now or at any point in the future from the Magazine for your Submission, its publication, or its commercial distribution.
1.4. You acknowledge that the sole consideration provided to you for an accepted Submission is public editorial credit (byline attribution) and promotional visibility on the Magazine's distribution networks.
2. Grant of Publishing Rights & Licensing
2.1. First United Kingdom Serial Rights: By submitting your work, you grant the Magazine the exclusive right to first publication of the Submission in the United Kingdom across all formats, including but not limited to print, digital editions, downloadable PDFs, website features, and corporate social media channels.
2.2. Exclusivity Window: Your grant of exclusivity remains binding for a period of one-hundred and eighty (180) days starting from the official publication date of the Magazine issue in which your Submission is featured. During this period, you agree not to publish, license, or display the Submission elsewhere online or in print within the UK.
2.3. Reversion of Rights: Following the expiration of the 180-day exclusivity window, the copyright and multi-platform publishing rights automatically revert to you. You may subsequently republish or license your work to other entities, provided that any future publication includes a credit line reading: "Originally published in SUCKER Magazine"
2.4. Archival License: Upon reversion of your rights, you grant the Magazine a perpetual, irrevocable, non-exclusive, worldwide, royalty-free license to host, archive, reprint, and distribute the Submission as part of the historical back-issues, compilations, digital indices, and physical archives of that specific edition.
2.5. Moral Rights: For the purposes of the Copyright, Designs and Patents Act 1988, you assert your moral right to be identified as the author of the Submission.
3. Absolute Originality, Plagiarism, and AI Restrictions
3.1. Author Warranties: You represent and warrant that you are the sole creator, author, and legal owner of the Submission; that the work is entirely original; and that it does not infringe upon any existing copyright, trademark, right of privacy, or proprietary interest of any third party under UK law.
3.2. Generative Artificial Intelligence (AI) Prohibition: The use of generative AI platforms, Large Language Models (LLMs), automated text generators, or algorithmic writing assistants to compose the prose, narrative structure, or core copy of the Submission is strictly prohibited.
3.3. Disqualification Protocols: Any instance of plagiarism, unauthorized paraphrasing, copyright violation, or generative AI utilization constitutes a material breach of this contract. Discovery of such activity will result in automatic, immediate removal from our editorial workflow. If a violation is verified after publication, the Magazine reserves the absolute right to permanently delete the content from all digital channels, issue a public retraction, and black-list the author from future considerations.
4. Data Protection, GDPR Compliance, and 90-Day Purge Protocol
4.1. The Magazine acts as the Data Controller for your information. We utilize JotForm as a third-party data processor. All data transmitted through the form is encrypted during transmission and storage using industry-standard protocols.
4.2. Automated Server Retention Limit: In accordance with the data minimisation principles under the UK GDPR and Data Protection Act 2018, all personal data, contact records, metadata, and uploaded digital documents tied to your entry will be automatically and permanently deleted from our active JotForm data servers exactly ninety (90) days following your submission timestamp, regardless of acceptance status.
4.3. Selected Work Exception: If your Submission is selected and formally accepted for publication by our editorial board, the Magazine will extract a localized working copy of the text file into our secure internal production ecosystem for editing, typesetting, and production. The original file hosted on the JotForm server will still be subject to the automated 90-day purge loop.
5. Editorial Control & Discretion
5.1. The Magazine retains absolute, unreviewable discretion regarding final curation, acceptance, or refusal of any entry. The Magazine is under no obligation to provide feedback, critiques, or justifications for rejected pieces.
5.2. You grant the Magazine the right to perform standard editorial alterations to accepted Submissions, including adjustments to formatting, typography, house-style grammar, syntax errors, and length limits. Material structural modifications affecting the core theme of the text will be presented to you for approval prior to publication.
6. Indemnification & Limitation of Liability
6.1. The Magazine, its founders, editors, and operational staff assume no liability for lost, corrupted, delayed, or unreadable files resulting from software glitches, network interruptions, or JotForm server downtime.
6.2. Indemnification: You agree to fully indemnify, defend, and hold harmless SUCKER, its founders, editors, directors, and assigns against any and all actual or threatened lawsuits, claims, losses, liabilities, financial damages, regulatory fines, and legal expenses (including reasonable legal fees) arising directly or indirectly out of:
(a) Any breach of your warranties under Section 3, including valid third-party claims of plagiarism, intellectual property theft, or copyright violation.
(b) Any hidden legal claims buried within your Submission, including libel, defamation, or violations of privacy laws.
6.3. Under this clause, if the Magazine is sued or fined by a third party because you plagiarized or broke copyright laws, you are contractually and financially responsible for covering our entire legal defense costs and any court-ordered payouts or damages.
7. Age Specifications and Capacity
7.1. By submitting your work, you verify that you are at least eighteen (18) years of age and possess full legal capacity to enter into a binding contract.
7.2. If you are under eighteen (18) years of age, your Submission cannot be processed directly. A parent or legal guardian must review these Terms and execute the form on your behalf, thereby assuming full liability for the content of the Submission under these Terms.
8. Governing Law and Exclusive Venue
8.1. This contract, and all claims, disputes, or causes of action arising out of the submission process, shall be governed by and construed strictly in accordance with the laws of England and Wales.
8.2. You explicitly agree that any legal action, dispute resolution, or litigation relating directly to these Terms must be filed exclusively in the courts of England and Wales, and you hereby consent to the personal jurisdiction of such courts.
