These Terms & Conditions ("Terms") govern the use of the SUCKER Magazine website ("Website"), the submission of editorial content to SUCKER Magazine ("Magazine"), and the purchase of physical copies of SUCKER Magazine through the Website.

By submitting content to us, placing an order through the Website, or otherwise using the relevant services provided through the Website, you agree to the Terms that apply to that activity.

If you do not agree to these Terms, please do not submit content or place an order through the Website.

1. About These Terms

1.1.

These Terms are divided into two principal areas:

Part A — Submissions: Sections 4 to 10 apply to individuals who submit articles, manuscripts, text, images, photography, artwork or multimedia content to SUCKER for editorial consideration.

Part B — Magazine Purchases: Sections 11 to 24 apply to customers who purchase physical copies of SUCKER Magazine through the Website.

1.2.

Different provisions may therefore apply depending on whether you are submitting work to SUCKER, purchasing a Magazine, or both.

1.3.

Nothing in these Terms is intended to exclude or restrict any rights or protections that cannot lawfully be excluded or restricted.

3. Acceptance Of These Terms

3.1.

Where these Terms relate to a Submission, you accept them by submitting, uploading, transmitting or otherwise providing your work to SUCKER through our submission process, including through JotForm or any other submission platform we may use.

3.2.

Where these Terms relate to a purchase, you accept the applicable purchasing provisions by placing an order through the Website.

3.3.

You should read these Terms carefully before submitting work or placing an order.

PART A — SUBMISSIONS TO SUCKER MAGAZINE

4. Nature Of The Relationship & Compensation

4.1.

SUCKER is an independent, early-stage publication operating with limited initial infrastructure and resources.

4.2.

All Submissions are made voluntarily and at the submitter's own discretion.

4.3.

Unless we expressly agree otherwise with you in writing before publication, no financial remuneration, monetary compensation, stipend, royalty or other payment will be made to you for an accepted Submission, its publication or its ordinary commercial distribution by SUCKER.

4.4.

The consideration for an accepted Submission is editorial consideration, publication where selected, author attribution where applicable, and promotional visibility through SUCKER's distribution channels.

4.5.

Acceptance of a Submission does not create an employment relationship, partnership, agency relationship or other relationship between you and SUCKER beyond the rights and obligations expressly set out in these Terms or separately agreed in writing.

5. Grant Of Publishing Rights & Licensing

5.1. First United Kingdom Publication Rights

By submitting your work, you grant SUCKER an exclusive licence to first publish the accepted Submission in the United Kingdom in connection with the relevant SUCKER Magazine issue.

This licence may cover print and digital publication, including physical Magazine issues, digital editions, downloadable PDFs, Website features, and SUCKER's official social media and promotional channels.

5.2. Scope Of The Licence

The rights granted under Section 5.1 apply only to the Submission accepted for publication and only to the extent reasonably necessary for SUCKER to edit, reproduce, publish, promote, distribute and archive that Submission.

You retain ownership of the copyright in your Submission unless you expressly agree otherwise in writing.

5.3. Exclusivity Period

The exclusive licence described in Section 5.1 will remain in force for one hundred and eighty (180) days beginning on the official publication date of the SUCKER Magazine issue in which your Submission first appears.

During this 180-day period, you agree not to publish, license or otherwise make the Submission available for publication elsewhere in the United Kingdom in a manner that conflicts with SUCKER's exclusive rights under these Terms.

5.4. Reversion Of Exclusive Rights

At the end of the 180-day exclusivity period, the exclusive publication rights granted to SUCKER under Section 5.1 will automatically expire.

You will then be free to republish or license your work elsewhere, subject to the continuing archival licence in Section 5.5.

Where your Submission is subsequently republished, you agree, where reasonably practicable, to include the following credit:

"Originally published in SUCKER Magazine."

5.5. Archival Licence

Following expiry of the 180-day exclusivity period, you grant SUCKER a perpetual, irrevocable, non-exclusive, worldwide, royalty-free licence to retain, host, archive, reproduce and distribute the published Submission as part of:

  • historical back issues;

  • digital archives;

  • compilations;

  • indexes and databases;

  • retrospective editorial collections; and

  • physical or digital archives relating to SUCKER.

This archival licence does not prevent you from using or licensing your work elsewhere.

5.6. Promotional Use

You grant SUCKER permission to reproduce reasonable excerpts, images, headlines, quotations or other portions of an accepted Submission for the purpose of promoting the relevant Magazine issue, SUCKER or the publication of your work.

Such promotional use may continue after the 180-day exclusivity period where reasonably connected to the historical promotion, archive or identification of SUCKER's published content.

5.7. Moral Rights

You assert your moral right to be identified as the author of your Submission in accordance with the Copyright, Designs and Patents Act 1988.

Where appropriate and where technically practicable, SUCKER will credit you by name or agreed byline.

6. Originality, Plagiarism & Artificial Intelligence

6.1. Author Warranties

By submitting a Submission, you represent and warrant that:

  • you are the original creator and author of the work, except for any material expresslyidentified and lawfully incorporated from another source;

  • you own or control the rights necessary to submit the work to SUCKER;

  • the Submission has not been knowingly copied from another person;

  • the Submission does not knowingly infringe another person's copyright, trademark, privacy, publicity or other proprietary rights;

  • any third-party material included in the Submission has been properly identified and lawfully used; and

  • the Submission does not knowingly contain unlawful, defamatory or fraudulent material.

6.2. Generative Artificial Intelligence

SUCKER does not accept Submissions in which generative artificial intelligence or large language model systems have been used to compose the prose, narrative structure or core written content of the Submission.

This includes, without limitation, the use of generative AI systems to generate, substantially rewrite or substantially paraphrase the substantive text submitted to SUCKER.

6.3.

Ordinary non-generative software tools, such as spelling or grammar checkers, accessibility tools, formatting software or similar tools that do not generate the substantive creative content of the Submission, are not by themselves prohibited under this section.

6.4. Disclosure

If you are unsure whether a tool or process used in creating your Submission falls within Section 6.2, you should disclose its use to SUCKER before submitting the work.

6.5. Breach

Plagiarism, deliberate copyright infringement, deliberate misrepresentation of authorship, or prohibited generative-AI use may constitute a material breach of these Terms.

Where such a breach is identified before publication, SUCKER may reject or remove the Submission from consideration.

Where such a breach is identified after publication, SUCKER may, where appropriate, remove the content from digital platforms, correct or retract the publication, and decline to consider future Submissions from the contributor.

SUCKER will consider the circumstances and available evidence before taking such action.

7. Submission Data, JotForm & Data Protection

7.1.

SUCKER acts as the data controller for personal information processed in connection with editorial Submissions, except where applicable law provides otherwise.

7.2.

We may use third-party service providers, including JotForm, to collect and process Submission information and uploaded files.

7.3.

Information submitted through the submission form may include your name, contact details, Submission materials, metadata and other information you voluntarily provide.

7.4.

Submission information will be processed for purposes including:

  • receiving and assessing Submissions;

  • contacting contributors;

  • editorial selection and administration;

  • editing and production;

  • publication and promotion;

  • maintaining appropriate records; and

  • complying with legal and regulatory obligations.

7.5. Submission Retention

Our intended retention period for information and files held through the active JotForm submission system is ninety (90) days from the relevant submission timestamp, afterwhich such information will be deleted from that active submission system, subject to technical limitations, legal obligations and any information that must lawfully be retained.

7.6. Selected Submissions

If your Submission is selected and formally accepted for publication, SUCKER may create and retain a working copy of relevant material within its internal production systems for editing, typesetting, publication, archive and record-keeping purposes.

Deletion of the original file from the JotForm submission system does not require SUCKER to delete a lawful working, production or published copy that it is entitled or required to retain.

7.7.

8. Editorial Control & Discretion

8.1.

SUCKER retains editorial discretion over the selection, acceptance, rejection, editing and publication of Submissions.

8.2.

Submission of work does not guarantee publication.

8.3.

SUCKER is not obliged to provide feedback, criticism, explanations or reasons for rejecting a Submission.

8.4.

We may reject a Submission for editorial, legal, practical, technical, quality, scheduling, space, thematic or other reasonable reasons.

8.5. Editorial Changes

SUCKER may make reasonable editorial alterations to accepted Submissions, including:

  • formatting;

  • typography;

  • spelling;

  • grammar;

  • punctuation;

  • house style;

  • syntax;

  • factual or consistency corrections;

  • captions and headings; and

  • reasonable length reductions or adjustments.

8.6.

Material structural changes that substantially alter the core meaning or theme of a Submission will, where reasonably practicable, be discussed with the contributor before publication.

8.7.

The final decision regarding publication, layout, presentation and issue placement remains with SUCKER, subject to any specific written agreement made with the contributor.

9. Indemnification & Liability — Submissions

9.1.

You are responsible for ensuring that your Submission complies with the warranties in Section 6.

9.2.

If a third party makes a legitimate claim against SUCKER arising directly from your deliberate or materially negligent breach of the warranties in Section 6, SUCKER may seek to recover losses that are reasonably attributable to that breach.

9.3.

This may include reasonable legal costs and other losses that SUCKER is legally entitled to recover.

9.4.

You are not responsible under this section for claims arising solely from SUCKER's own independent actions, editorial decisions or modifications that were not based on material supplied by you.

9.5.

Nothing in these Terms requires you to indemnify SUCKER for liability that arises from SUCKER's own negligence, unlawful conduct or breach of its own legal obligations.

10. Age & Capacity

10.1.

By submitting a Submission directly to SUCKER, you confirm that you are at least eighteen (18) years old and have the legal capacity to enter into these Terms.

10.2.

If you are under eighteen (18), you must not submit a Submission directly under these Terms unless SUCKER has expressly agreed to an alternative process.

Where SUCKER permits a minor's work to be submitted, a parent or legal guardian must review and accept the applicable terms on the minor's behalf.

10.3.

Where a parent or legal guardian accepts these Terms on behalf of a minor, they confirm that they have the authority to do so.

PART B — BUYING SUCKER MAGAZINE

11. Magazine Purchases

11.1.

SUCKER sells individual physical issues of the Magazine through the Website.

11.2.

We currently sell and deliver physical Magazine issues within the United Kingdom only.

11.3.

We do not currently offer Magazine subscriptions through the Website.

11.4.

Each product listing will provide relevant information about the Magazine issue, including, where applicable, its edition, contents, format, price, availability and quantity.

11.5.

Product images are provided to give a reasonable representation of the Magazine. Minor differences in colour, appearance or presentation may occur between images displayed online and the physical product.

12. Availability & Limited Print Runs

12.1.

All Magazine issues are subject to availability.

12.2.

SUCKER may produce limited print runs of individual issues.

12.3.

Once an issue has sold out, SUCKER is not obliged to produce additional copies unless we expressly state otherwise.

12.4.

Where an issue is expressly described as a limited edition or limited print run, availability will be limited to the quantity stated or otherwise reasonably available.

12.5.

We may impose reasonable quantity limits on individual orders where necessary, including to prevent bulk purchasing or resale from unfairly restricting availability to other customers.

13. Prices & Payment

13.1.

All Magazine prices are displayed in pounds sterling (£).

13.2.

The price payable for a Magazine will be the price displayed at the time you place your order, subject to any obvious pricing or technical error.

13.3.

Any applicable delivery charge will be displayed before you complete your purchase.

13.4.

Where VAT is applicable, prices will be displayed in accordance with applicable tax requirements.

13.5.

Payment must be made using one of the payment methods made available at checkout.

13.6.

Payment must be successfully authorised before an order is dispatched.

13.7.

If payment fails or is reversed, we may cancel or suspend the relevant order.

13.8.

Payment card details may be processed by a third-party payment provider. SUCKER does not intentionally retain full payment card details on its own systems where the payment provider handles that information.

14. Orders & Contract Formation

14.1.

When you submit an order through the Website, you are making an offer to purchase the selected Magazine issue(s).

14.2.

Before completing your order, you should have an opportunity to review the contents of your order and correct any errors.

14.3.

You are responsible for ensuring that the information you provide, including your name, email address and delivery address, is accurate and complete.

14.4.

An automated acknowledgement that your order has been received does not necessarily mean that SUCKER has accepted the order.

14.5.

The contract between you and SUCKER will be formed when we confirm acceptance of your order, ordinarily by email or by dispatch of the relevant Magazine.

14.6.

Once accepted, your order confirmation will contain relevant details of your purchase.

14.7.

You should retain your order confirmation and these Terms for your records.

15. Order Cancellation By SUCKER

15.1.

We may cancel an order before dispatch where:

  • the requested Magazine issue is unavailable;

  • there has been an obvious pricing or product-listing error;

  • payment has not been successfully authorised;

  • we reasonably suspect fraudulent or unauthorised activity; or

  • circumstances outside our reasonable control prevent us from fulfilling the order.

15.2.

If we cancel an order after payment has been taken, we will refund the amountpaid for the cancelled order.

16. Delivery

16.1.

We currently deliver Magazine orders to addresses within the United Kingdom only.

16.2.

Orders are dispatched using Royal Mail or an appropriate Royal Mail service selected by SUCKER.

16.3.

The applicable delivery charge and available delivery option will be displayed at checkout.

16.4.

Any delivery times displayed on the Website are estimates unless we expressly agree a specific delivery date or period with you.

16.5.

Unless another period has been agreed, we will deliver your order without undue delay and, in general, within thirty (30) days after the contract is entered into.

16.6.

We are not responsible for delivery delays caused by circumstances outside our reasonable control, including postal disruption, strikes, severe weather, transport disruption or other events affecting Royal Mail or other delivery services.

16.7.

A delivery delay does not remove any statutory rights you may have against SUCKER.

17. Delivery Addresses & Lost Orders

17.1.

You are responsible for providing a complete and accurate delivery address.

17.2.

If an order is returned to us because an incorrect or incomplete address was supplied by you, we will contact you where reasonably practicable to determine whether the order can be resent.

17.3.

Where legally permitted, additional postage costs resulting directly from an incorrect address supplied by you may be charged before an order is resent.

17.4.

We will investigate the delivery and take appropriate action.

17.5.

You are not required to pursue a compensation claim against Royal Mail yourself in order to exercise any applicable rights against SUCKER.

18. Risk & Delivery

18.1.

The risk of loss or damage to a Magazine remains with SUCKER until the Magazine comes into the physical possession of you or a person you have identified to receive it, other than a carrier.

18.2.

If a Magazine is lost or damaged in transit before delivery, we will address the matter in accordance with applicable law and your statutory rights.

19. Returns, Refunds & Faulty Magazines

19.1. Change Of Mind

Individual physical issues of SUCKER Magazine cannot be returned or refunded solely because you have changed your mind, no longer want the Magazine, ordered the wrong issue, or otherwise decide that you do not wish to keep it.

This policy applies only to change-of-mind returns and does not affect statutory rights relating to faulty, damaged, incorrectly supplied or misdescribed goods.

19.2. Faulty Or Damaged Magazines

If your Magazine arrives damaged or defective, please contact us as soon as reasonably practicable at:

Please include your order number and, where possible, photographs showing the damage or defect.

19.3. Incorrect Or Misdescribed Magazines

If you receive the wrong issue or the Magazine materially does not correspond with its description, please contact us as soon as reasonably practicable.

19.4.

Depending on the circumstances and applicable law, an appropriate remedy may include a replacement, repair where applicable, price reduction or refund.

19.5.

Nothing in these Terms removes or restricts your statutory rights in relation to goods that are not of satisfactory quality, are not fit for purpose, or do not match their description.

19.6. Return Postage

Where a Magazine must be returned because it is faulty, damaged, incorrectly supplied or otherwise covered by a statutory remedy, SUCKER will deal with return postage in accordance with applicable law.

19.7. No General Exchange Policy

We do not operate a general exchange service for individual Magazine issues.

Where a statutory remedy applies, we will provide the remedy required by law.

20. Refunds

20.1.

Where a refund is due under these Terms or applicable law, we will normally issue the refund using the original payment method.

20.2.

The time taken for the refund to appear may depend on your bank, card provider or payment provider.

20.3.

We will not replace a legally required refund with store credit or another alternative unless you agree to that alternative.

21. Pre-Orders

21.1.

If SUCKER offers a Magazine issue for pre-order, the product listing will clearly identify it as a pre-order.

21.2.

An estimated publication or dispatch date may be provided.

21.3.

Where a stated date is described as an estimate, it may change.

21.4.

If a significant delay occurs, we will contact affected customers where reasonably practicable and provide any remedy required by applicable law.

22. Promotional Offers & Discount Codes

22.1.

Promotional codes, discounts and special offers may be subject to additional conditions displayed with the relevant promotion.

22.2.

Unless expressly stated otherwise:

  • promotional codes cannot be exchanged for cash;

  • promotional codes cannot be applied retrospectively to completed orders;

  • only one promotional code may be used per order; and

  • promotional codes cannot be combined with other promotional offers.

22.3.

We reserve the right to withdraw or amend a promotional offer where required by law or where an obvious error has occurred.

22.4.

Promotional offers will not be presented in a way that deliberately misleads customers about the price, availability or nature of the offer.

23. Website Use & Intellectual Property

23.1.

Unless otherwise stated, the Website and its content, including text, graphics, photographs, logos, artwork, designs, layouts and other materials, are owned by or licensed to SUCKER or the relevant rights holder.

23.2.

Purchasing a physical copy of SUCKER Magazine does not transfer ownership of the copyright or other intellectual property rights in its editorial content, photography, artwork, design or other materials.

23.3.

You may use your purchased Magazine for personal purposes.

23.4.

You must not reproduce, commercially distribute, sell, modify or otherwise commercially exploit substantial portions of the Magazine or Website content without the permission of the relevant rights holder, except where permitted by law.

23.5.

The rights of individual contributors, photographers, artists and other creators may be governed by separate agreements with SUCKER.

24. Website Availability, Errors & Technical Issues

24.1.

We aim to keep the Website accurate, secure and available, but we do not guarantee that it will always be uninterrupted, error-free or available at all times.

24.2.

We may temporarily suspend or modify parts of the Website where reasonably necessary for maintenance, security, technical issues or operational reasons.

24.3.

If a technical or pricing error materially affects an order, we may take reasonable steps to correct the error and, where necessary, cancel the affected order and provide a refund of any payment already made.

24.4.

Nothing in this section limits your statutory consumer rights.

25. Privacy & Personal Data

25.1.

We process personal information in accordance with applicable UK data protection law and our Privacy Policy.

25.2.

Personal information collected through Magazine purchases may be used for purposes including:

  • processing and administering orders;

  • processing payments;

  • arranging delivery;

  • communicating with customers;

  • providing customer support;

  • preventing fraud;

  • maintaining appropriate transaction records; and

  • complying with legal obligations.

25.3.

We may share relevant information with service providers where necessary to fulfilan order, such as payment providers, website providers and delivery providers.

25.4.

Please see our Privacy Policy for information about how personal data is collected, used, stored, retained and protected, and about the rights available to individuals.

26. Complaints

26.1.

If you have a complaint about SUCKER, an order, delivery, a Magazine issue or our service, please contact: dan@suckermagazine.com

26.2.

Please include your order number where applicable and provide a clear description of the issue.

26.3.

We will aim to acknowledge and investigate complaints within a reasonable period.

26.4.

Nothing in this complaints procedure affects your statutory rights.

27. Limitation Of Liability

27.1.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

27.2.

In particular, nothing in these Terms excludes or limits liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded or limited.

27.3.

Nothing in these Terms excludes or limits your statutory rights as a consumer.

27.4.

Subject to the above, SUCKER will not be responsible for losses that were not reasonably foreseeable at the time the relevant contract was entered into.

27.5.

Nothing in this section is intended to exclude responsibility for supplying goods that are faulty, not as described, or otherwise fail to comply with applicable consumer law.

28. Events Outside Our Reasonable Control

28.1.

We will not be responsible for delay or failure to perform an obligation where the delay or failure results from circumstances outside our reasonable control.

28.2.

Such circumstances may include, without limitation:

  • severe weather;

  • natural disasters;

  • fire or flood;

  • industrial disputes;

  • postal disruption;

  • strikes;

  • transport disruption;

  • interruption to utilities;

  • technical failures;

  • cyber incidents;

  • government action; or

  • other events beyond our reasonable control.

28.3.

Where such an event affects an order or Submission, we will take reasonable steps to minimise the impact and continue performance as soon as reasonably practicable.

28.4.

Nothing in this section removes any statutory consumer rights that apply to an order.

29. Changes To These Terms

29.1.

We may update these Terms from time to time to reflect changes to our business, Website, products, submission process or applicable law.

29.2.

The version of these Terms in force at the time you submit a Submission or place an order will ordinarily apply to that Submission or order.

29.3.

Changes will not retrospectively alter the terms of an order that we have already accepted, except where a change is required by law.

29.4.

The latest version of these Terms will be made available on the Website.

30. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary, while the remaining provisions will continue to apply.

31. No Waiver

If SUCKER does not immediately enforce a right or provision under these Terms, this does not mean that SUCKER has permanently waived that right or provision.

32. Consumer Rights

Nothing in these Terms is intended to exclude, restrict or otherwise limit any consumer rights or remedies that cannot lawfully be excluded or limited.

In particular, nothing in these Terms affects statutory rights relating to goods that are not of satisfactory quality, are not fit for their ordinary or agreed purpose, do not match their description, or are otherwise supplied in breach of applicable consumer law.

33. Governing Law & Jurisdiction

33.1.

These Terms are governed by the laws of England and Wales, subject to any mandatory consumer protections or jurisdictional rights that apply to you.

33.2.

Where permitted by law, disputes arising out of these Terms or your dealings with SUCKER will be subject to the jurisdiction of the courts of England and Wales.

33.3.

Nothing in this section prevents a consumer from relying on any mandatory legal protection or bringing proceedings in another jurisdiction where applicable law gives them that right.
